Terms of Service

• You must be at least 18 years old, and old enough to enter a binding contract where you live.
• You may not use the Service if you are barred from it under the laws of your country, or if we have closed an account of yours before.
• You are responsible for making sure the Service is legal for you to use where you are.

• One person, one account. Accounts are personal and may not be sold, shared, lent or transferred.
• Keep your password private and turn on two factor authentication if you can. You are responsible for what happens on your account until you tell us it has been compromised.
• Your username appears publicly on leaderboards and on the activity feed. Do not choose one that is offensive, impersonates someone, or infringes anyone's rights. We may change or remove a username that breaks this rule.
• Tell us at once at the address in section 17 if you think someone else has accessed your account.

• You can buy coins in the store or earn them by playing, for example through the daily login ladder.
• When you buy coins you receive a limited, personal, revocable licence to use them inside the Service. You do not own them, and they are not a deposit, a stored value account or a financial product.
• Coins are delivered to your account as soon as your payment is confirmed. Prices are shown before you pay, in US dollars, and include any taxes we are required to collect unless stated otherwise.
• Coins are only usable in the Service. They expire if your account is closed, and they may be removed if they were obtained through fraud, a chargeback, a refund, a bug or a breach of these terms.
• We may change coin prices, packs and what coins can be used for at any time. That never affects coins already in your account, except as set out in this section.

Refunds are covered by our Refund Policy, which forms part of these terms.

Some games in STAKD, including dice, crash, blackjack, slots, roulette and plinko, are free play demonstrations. They use play chips that are given for free, cannot be bought, have no value of any kind and cannot be exchanged for coins, ARK, money or prizes. No purchase is ever needed to play them, and nothing you win or lose in them has any effect outside the demonstration.

• Ranked results are verified on our servers by replaying your inputs. Only the result our servers compute counts.
• We may withhold, remove or reset any result, ranking or reward that we reasonably believe came from cheating, automation, exploits or a fault in the Service.
• The Fair Play Rules form part of these terms.

ARK features are described in the ARK Disclosure, which forms part of these terms. In short: ARK is not sold through STAKD, coins can never be converted into ARK or into money, a claim shown in the Vault is not a token in your possession, and nothing in the Service is an offer of an investment.

You agree not to:

• cheat, use bots, scripts, macros, modified clients or any automation, or exploit bugs, and you agree to report bugs you find instead of using them;
• interfere with, probe, scan or attack the Service, its servers or its security, or access anything you are not meant to;
• create more than one account, or create accounts to farm rewards, referrals or the daily ladder;
• sell, buy or trade accounts, coins or anything else from the Service outside the Service;
• harass, threaten or abuse anyone, or post anything unlawful, hateful or sexually explicit;
• use the Service for money laundering, fraud or any unlawful purpose, or use payment methods you are not authorised to use;
• copy, reverse engineer or resell any part of the Service, except where the law allows it despite this restriction.

The Service, its games, art, code, names and logos belong to Everreach Labs, Inc. or its licensors and are protected by law. We give you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial entertainment, as these terms allow. Anything you submit to the Service, such as your username or feedback, you license to us worldwide and without charge so that we can run and improve the Service.

STAKD is a live service and will change. We may add, change or remove games, features, rewards and content, and we may run the Service in early access. Where a change materially reduces what you paid for, we will tell you in advance where we reasonably can.

• You can stop using the Service at any time and ask us to delete your account by writing to us. Deleting your account ends your access to any coins, progress and claims on it.
• We may suspend or close your account, and remove coins, progress or claims on it, if you breach these terms, if we are required to by law, or if we reasonably suspect fraud or abuse. Where possible we will tell you why and give you a chance to respond.
• If we close the Service entirely, we will give at least 30 days notice in the Service, and the Refund Policy explains what happens to unused coins you bought.

Payments are processed by Stripe. We never see or store your full card details. If you dispute a payment with your bank or card issuer, we may reverse the coins it bought and suspend the account while the dispute is open. Please contact us first, we will try to fix any problem directly.

The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including that the Service will be uninterrupted, error free or secure, or that any data will be preserved. Some places do not allow these exclusions, so some of them may not apply to you.

To the fullest extent the law allows, Everreach Labs, Inc. will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, coins, claims or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or US $100. Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be limited by law.

You agree to compensate us for reasonable losses and costs, including legal fees, arising from your breach of these terms or your misuse of the Service, except to the extent caused by us.

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. Disputes will be heard by the state or federal courts located in Delaware, and you and we agree to their jurisdiction. If you are a consumer living in the European Union, the United Kingdom or another country that gives you mandatory consumer protections, you keep those protections and may also bring proceedings in the courts where you live.

We may update these terms. We will post the new version here with a new date and, for material changes, tell you in the Service or by email before they take effect. If you keep using the Service after that, the new terms apply. If you do not agree, stop using the Service and you may ask us to delete your account.

If any part of these terms is found unenforceable, the rest stays in force. Our failure to enforce a term is not a waiver of it. You may not transfer these terms; we may transfer them to a successor of the Service. These terms, together with the policies they refer to, are the whole agreement between us about the Service.
